Social Security is not just for retirement income. SSDI provides payments for people who can no longer work because they are disabled, but there are strict requirements as to who is eligible for these benefits. I can help you with these processes:

  • Eligibility  To be eligible for SSDI benefits, you must have worked, paid Social Security taxes and become totally disabled. Applicants who are over 31 years of age must have earned 20 “work credits” within the last 10 years; you earn up to four work credits for each year you receive wages and pay FICA taxes. SSDI uses a complex grid system for determining whether you are disabled that takes into account your age, education, work history, skills and current abilities based on your medical records and other evidence.
  • Application  The first steps toward getting benefits include gathering your evidence and filing an application for SSDI. You may apply online, by calling the Social Security Administration’s toll-free number, or by visiting a local Social Security office.
  • Hearing — Unfortunately, the Social Security Administration denies many disability applications, even when the applicants have a good case. However, you have the right to appeal the decision in a hearing before an administrative law judge. It is important to go to this hearing because many denials are reversed at the hearing stage. If you don’t win at the hearing, you can request a review from the Appeals Council or file a lawsuit in federal court.
